1. Agreement

By creating an account or using ApplyTrace, you agree to these Terms of Service and our Privacy Policy.

2. Eligibility

You must meet the minimum age and other eligibility requirements under the local laws that apply to you for using our service. You represent that the information you provide is accurate and that you will keep your account secure.

3. Description of Service

ApplyTrace provides job application tracking and AI-assisted tools (e.g., suggested answers to application-related questions). AI features are powered by third-party providers (OpenAI and/or AWS Bedrock). We do not guarantee job offers, placement, or any specific outcomes.

4. Your Content and Conduct

You are responsible for all content you submit (resumes, job details, questions). You must not use the service for any illegal purpose, to infringe others' rights, or to abuse our or our providers' systems. We may suspend or terminate your access for violation of these terms or for abuse.

5. AI-Generated Content

AI-generated text is provided for assistance only. We do not guarantee its accuracy, completeness, or suitability. You are responsible for reviewing and verifying all AI-generated responses, resumes, and outputs before use. AI can be wrong; you should verify any response that you rely on. Do not rely on AI output as legal, career, or professional advice.

6. Fair Use of AI Features

If usage of AI-generated content or AI features exceeds our cost to provide them, we reserve the right to limit AI usage, including for paid users, to ensure sustainable and fair use of the service.

7. Intellectual Property

You retain ownership of your content. You grant us a license to use, store, and process it as needed to provide the service (including sending it to AI providers as described in our Privacy Policy).

8. Free and Paid Service; Refunds

We offer free and paid (premium) versions. If the service has not been used, we offer a maximum 90-day refund policy. If the service has been used and you are not satisfied, we will try to address the issue or, where applicable, provide a refund within our 90-day refund policy.

9. Disclaimers

The service is provided "as is." We disclaim warranties to the fullest extent permitted by law. ApplyTrace does not guarantee employment, interview, or placement outcomes. AI content is not legal or professional advice. You are responsible for the content you submit and how you use AI output.

10. Limitation of Liability

To the extent permitted by applicable law, ApplyTrace and its affiliates, officers, and agents shall not be liable for indirect, incidental, special, or consequential damages. Our refund policy (up to 90 days if the service has not been used, or we try to address issues or provide a refund if the service has been used and is unsatisfactory) applies as described in Section 8. Some jurisdictions do not allow certain limitations; in those, our liability is limited to the maximum permitted.

11. Indemnity

You agree to indemnify and hold us harmless from claims arising from your use of the service, your content, or your violation of these terms.

12. Termination

You may delete your account at any time. We may suspend or terminate your access with or without notice for abuse or other reasons. We may treat free accounts as inactive after 90 days of no activity. On termination, your right to use the service ends. We will handle your data as described in our Privacy Policy.

13. Changes to Terms

We may change these Terms from time to time. We will post the updated version and update the "Last updated" date. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the service.

14. Governing Law and Disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these terms or the service shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in Delaware. Judgment on the award may be entered in any court having jurisdiction. To the extent arbitration is not permitted by applicable law, the exclusive jurisdiction and venue shall be the state and federal courts located in Delaware.

15. General

If any part of these terms is held invalid, the rest remains in effect. Our failure to enforce any right does not waive that right.
